Terms of Use
The rules that apply to this website, and the limits of what it can do.
Draft — not yet in force
This page is a working outline, not Beacon Point's terms of use. Terms of use are a contract, so the operative wording has to be reviewed by Beacon Point Insurance Group's legal counsel or errors-and-omissions carrier before launch. Nothing below is in force yet. The one piece of approved language on this page is the insurance disclosure, which is marked where it appears.
Use of this site
This section will set out who may use the site and how. In plain terms: the site is here to explain insurance and to let you start a review or reach your Client Portal. It is not to be scraped, copied wholesale, used to send anything harmful, or used to misrepresent yourself. It will also say that the agency can change or take down pages without notice, and that information on the site is general and can go out of date.
This site does not bind coverage
This is the most important thing on the page, and it is the one part below that is approved language rather than an outline. It applies everywhere on the site, not only here:
Information on this website is general in nature and is not a complete description of any insurance policy or every coverage option that may be available. Coverage availability, terms, conditions, limits and exclusions vary by insurer, policy and individual circumstances. The issued insurance policy and applicable endorsements control coverage. Beacon Point Insurance Group may provide information regarding available insurance options and discuss coverage considerations based on information you provide, but customers are responsible for selecting the carrier, coverages, limits and deductibles they wish to purchase. No insurance coverage is bound, changed, or canceled through this website unless confirmed by Beacon Point Insurance Group or the applicable insurer.
The reviewed clause will restate this in contract terms and add the practical consequence: nothing you submit through this website starts, changes, or ends insurance, and you should not act as if it has until a person at Beacon Point Insurance Group or the insurance company confirms it. If you need something effective on a particular date, call (816) 254-6100.
Links to other websites
This section will explain that the site links out — to insurance companies, to government resources such as Medicare, and most often to the Open Client Portal, which is a separate servicing system rather than a part of this website. Those destinations have their own terms and their own privacy practices, and Beacon Point does not control what they publish or how they behave. The clause will say that following a link means leaving these terms behind.
Intellectual property
This section will say that the text, layout, photography, illustrations and the Beacon Point name and mark on this site belong to Beacon Point Insurance Group or are used with permission, and what you may do with them — reading, printing and sharing a page is fine; republishing the content as your own is not. It will note that third-party marks that appear on the site belong to their owners.
Limitation of liability
This section will state that the site is provided as it is, without warranties, and will set the limits of what the agency is responsible for if the site is unavailable, contains an error, or is relied on in place of a conversation with a licensed agent. The enforceable form of this language varies by state and is not something to draft from a template — counsel will write it against Missouri law.
Governing law
This section will state that these terms are governed by the laws of the State of Missouri, and will name where disputes are heard. Beacon Point Insurance Group operates from Independence, MO, so counsel will set the venue accordingly.
